What Counts as Cheating Under Section 318 BNS?
Cheating occurs when a person deceives another, dishonestly induces them to deliver property or to consent to retain property, or induces them to do or omit an act they would not have done otherwise, causing wrongful loss or damage. Section 318 BNS also carries an aggravated provision for cheating with knowledge that wrongful loss is likely to be caused to a person whose interest the accused was bound to protect.

Punishment Under Section 318 BNS
- Simple cheating: imprisonment up to 3 years, or fine, or both
- Cheating with knowledge that wrongful loss is likely to a person whose interest the accused was bound to protect: imprisonment up to 5 years, or fine, or both
- Cheating and dishonestly inducing delivery of property, or destruction of a valuable security: imprisonment up to 7 years, and fine
Is Section 318 BNS Bailable?
The basic offence under Section 318(1)/(2) BNS is non-cognizable and bailable. The more serious offence involving dishonest inducement to deliver property (corresponding to the old Section 420 IPC) is cognizable and non-bailable, meaning the police can arrest without a warrant and bail is not automatic — it must be sought from the court.

How to Defend a Cheating Case
A cheating charge requires proof of dishonest intention at the time the promise was made, not merely that a transaction later went wrong. Common defences include showing a genuine business dispute rather than fraudulent intent, absence of wrongful loss, delay in filing the complaint, or that the dispute is civil in nature and criminal law is being misused for recovery.
