The Delhi Police registered my case under an incorrect penal section. During trial the prosecution now wants to add a more serious charge. Can charges be altered or new charges be added during trial after framing of charges has already been done and what is the procedure?

Yes, a criminal case filed under a wrong section can indeed be corrected during trial in Delhi, since Indian criminal procedure specifically empowers courts to alter or add charges at any stage of the trial before judgment is pronounced, under provisions allowing correction of charges to properly reflect the actual offence disclosed by the evidence, ensuring that a genuine factual and legal error in the initial charge does not derail the pursuit of justice.

If the evidence presented during trial reveals that the conduct alleged actually falls under a different statutory provision than initially charged, or that the initial charge under-classified or over-classified the alleged offence based on a misreading of the applicable law, the court can amend the charge accordingly, provided the accused is given proper notice of the amended charge and a genuine opportunity to respond and defend against it without unfair prejudice from the alteration.

This correction mechanism exists precisely because charges are sometimes framed based on preliminary investigation before all evidence has been fully examined, and rigid adherence to an initially incorrect charge, despite evidence clearly establishing a different or more accurate characterisation of the offence, would undermine rather than serve the interests of justice. However, courts are careful to ensure that any such amendment does not cause genuine prejudice to the accused's ability to mount an effective defence.

If you believe the charge in your Delhi criminal case has been incorrectly framed under the wrong section, whether because it does not accurately reflect the alleged conduct or misapplies the relevant law, it is important to raise this concern with experienced criminal defence counsel who can assess whether this presents a defence opportunity or whether correction might actually be sought by the prosecution. Consulting the team at Aapka Legal Advice can help you navigate charge-related issues in your Delhi criminal case.

Given the significant strategic implications of charge alteration, whether you are seeking correction or defending against an unfair amendment, obtaining a second opinion from a retired judge on how this issue is likely to be handled in your specific case can provide valuable clarity. In conclusion, a criminal case filed under a wrong section can indeed be corrected during trial in Delhi, provided the accused receives proper notice and a fair opportunity to respond, ensuring the trial ultimately proceeds on an accurate legal foundation.
