The offence against me is one that is exclusively triable by the Delhi Sessions Court. I want to file a private complaint directly. Can a private complainant approach the Sessions Court directly or must all private complaints be filed only before the Magistrate regardless of which court will ultimately try the offence?

Generally, no โ€” a private person cannot directly file a complaint before a Delhi Sessions Court in most circumstances, since the standard procedure under Indian criminal law requires complaints to first be filed before a Magistrate, who then examines the complaint, may conduct a preliminary inquiry, and if warranted, either takes cognizance directly for triable offences or commits the case to the Sessions Court for offences exclusively triable by that higher court.

This structured hierarchy exists to ensure appropriate preliminary screening of complaints before they reach the Sessions Court, which handles more serious offences typically carrying higher potential sentences, and bypassing this Magistrate-level screening would undermine the established procedural safeguards designed to filter out frivolous or legally deficient complaints before they proceed to the more resource-intensive Sessions Court trial process.

There are limited statutory exceptions where specific legislation may permit certain categories of complaints to be filed more directly, though these remain exceptions to the general rule rather than the standard pathway, and even in such cases, specific procedural requirements typically still apply. For the vast majority of criminal complaints in Delhi, the correct approach remains filing before the appropriate Magistrate, who will then determine the correct forward path based on the nature and gravity of the alleged offence.

If you are considering filing a criminal complaint and are uncertain about the correct forum, it is important to consult experienced criminal law counsel who can properly assess which court has jurisdiction over your specific matter and guide you through the correct filing procedure. Consulting the team at Aapka Legal Advice can help you determine the appropriate forum and properly draft your complaint for filing in Delhi.

Given the procedural complexity involved in correctly identifying the appropriate court and following the proper complaint filing process, obtaining a second opinion from a retired judge on the correct procedural pathway for your specific matter can help you avoid unnecessary delays. Delhi's experienced criminal lawyers and retired judges, available through Aapka Legal Advice's Delhi criminal lawyer directory, can guide you accurately.

In conclusion, a private person generally cannot directly file a complaint before a Delhi Sessions Court, since the standard procedure requires initial filing before a Magistrate, who then determines the appropriate forward path based on the nature of the alleged offence.
