The Delhi Police have filed a closure report in my case stating that no evidence was found. I believe the investigation was superficial and biased. Can I file a fresh FIR on the same incident or approach the Magistrate to direct a proper investigation after a closure report has been accepted?

A genuinely important question for complainants dissatisfied with how their case is being handled is whether a second FIR can be filed if a Delhi Police investigation is inadequate, and the answer requires careful navigation of specific legal principles. A second FIR generally cannot be filed on the same facts if a Delhi Police investigation is inadequate, since Indian law, following the well-established principle against successive FIRs on the same cause of action, treats a second FIR covering substantially the same incident as impermissible, precisely to prevent harassment through repeated, overlapping criminal complaints.

Where a Delhi Police investigation is genuinely inadequate, the appropriate remedy is not a second FIR but rather a protest petition before the Magistrate if a closure report has been filed, or, during an ongoing investigation, a representation to the investigating officer's superior, or in more serious cases, a writ petition before the Delhi High Court seeking a direction for proper, thorough investigation, or in appropriate circumstances, transfer of the investigation to a different agency such as the CBI. Courts have recognised a narrow exception allowing a second FIR where it reveals a distinct, separate offence not covered by the first FIR, or where new facts emerge that constitute a genuinely different transaction rather than merely elaborating on or supplementing the same original incident.

It is worth understanding that persistently pursuing the correct remedy โ€” improving the existing investigation through proper channels rather than attempting to file a fresh FIR โ€” considerably improves your prospects, since courts are unlikely to treat a second FIR on the same facts favourably, regardless of how genuinely inadequate the first investigation may have been.

Given how much depends on correctly identifying whether your situation involves a genuinely separate offence or simply an inadequately investigated original complaint, careful legal guidance is essential. Our legal experts at Aapka Legal Advice include retired judges who can assess the correct remedy for your specific situation. Our Criminal Lawyers in Delhi | Aapka Legal Advice regularly pursue protest petitions and writ remedies to address inadequate police investigations in Delhi.

In conclusion, a second FIR generally cannot be filed simply because a Delhi Police investigation is inadequate, but genuine remedies exist through protest petitions, superior officer representations, and writ petitions to compel proper investigation instead.
