I have preserved screen recordings and screenshots of the abusive messages, fake profiles and defamatory posts that form the basis of my cybercrime complaint. Will Indian criminal courts accept screen recordings and screenshots as valid electronic evidence and what formalities must be followed to make them admissible in Delhi?

If you are building a cybercrime complaint in Delhi and wondering whether screen recordings and screenshots you have collected can serve as valid evidence, you will be reassured to know that Indian law does recognize such digital evidence as admissible, provided it is properly preserved and presented in compliance with the specific legal requirements governing electronic evidence. Under Section 65B of the Evidence Act, electronic records, including screenshots and screen recordings, can be admitted as evidence provided they are accompanied by a proper certificate confirming the authenticity and integrity of the electronic record, a procedural requirement that Delhi courts apply consistently to ensure the reliability of digital evidence presented before them.

To maximize the evidentiary value of your screenshots and screen recordings, it is essential to ensure they clearly capture relevant identifying information, including timestamps, sender or account details, and complete context of the communication or content in question, since incomplete or cropped screenshots that lack this contextual information can be challenged for authenticity or relevance during trial, potentially undermining their evidentiary weight even if the underlying content genuinely supports your complaint.

It is also advisable, wherever possible, to preserve the original digital files alongside your screenshots, such as the actual video files for screen recordings or the original messages before they are screenshotted, since courts and forensic experts may need to examine the underlying metadata to verify authenticity, particularly in cases where the accused disputes the genuineness of the evidence presented.
