My co-accused who faces identical allegations has already been granted regular bail by the Kolkata Sessions Court. Can the bail order granted to my co-accused in the same case be relied upon as a strong ground in my application for anticipatory bail before the same or a higher court?

If a co-accused in your case has already been granted bail, whether regular or anticipatory, by a court in Kolkata, this can indeed strengthen your own anticipatory bail application, since courts often consider the principle of parity, meaning similarly situated accused persons should generally be treated consistently unless there's a specific reason to distinguish between them. If your role in the alleged offence is similar to, or less significant than, that of the co-accused who has already secured bail, your advocate can present this as a strong supporting argument, highlighting that there's no principled basis for treating you more harshly than someone in a comparable or more serious position.

However, this parity argument isn't automatic or guaranteed to succeed, since courts examine whether the co-accused's situation is genuinely comparable to yours, considering factors like your specific role in the alleged offence, any differences in the evidence against each of you individually, and whether the co-accused's bail was granted for reasons specific to their circumstances that don't necessarily apply to your situation, such as their voluntary surrender, cooperation with investigation, or particular personal circumstances the court considered relevant to their case alone.

Presenting an effective parity argument requires your advocate to clearly draw out the similarities between your position and the co-accused's, addressing proactively any potential distinctions the prosecution might raise to argue that your situations aren't truly comparable, since a well-prepared parity argument can be genuinely persuasive, but a superficial one that ignores real differences between your roles is unlikely to carry much weight with the court.

Because effectively leveraging a co-accused's bail order requires careful comparative analysis of both cases and anticipating counterarguments, this needs thoughtful preparation rather than a simple reference to the other bail order. Aapka Legal Advice can help build a strong parity-based argument for your anticipatory bail application where the facts genuinely support it.

If a co-accused in your Kolkata case has already secured bail, this may well strengthen your own application. Consult experienced criminal lawyers in Kolkata about building an effective parity argument for your anticipatory bail.
