I have already filed a divorce petition against my husband citing cruelty. My lawyer is now advising me to also file a criminal complaint for the same acts of harassment. Can criminal proceedings for marital harassment run simultaneously with a pending civil divorce petition and will one affect the outcome of the other in Kolkata?

If you're pursuing both a criminal complaint for marital harassment and a divorce petition in Kolkata, you'll be relieved to know that these two proceedings can absolutely run simultaneously, since they operate under entirely different legal frameworks with different purposes and are heard by different courts or forums. Your criminal complaint under Section 85 of the Bharatiya Nyaya Sanhita (formerly Section 498A IPC) proceeds before the criminal court, focused on establishing whether a criminal offence of cruelty occurred and imposing appropriate punishment, while your divorce petition, whether under the Hindu Marriage Act, Special Marriage Act, or other applicable personal law, proceeds before the family court, focused on dissolving the marriage and addressing related issues like alimony, custody, and property.

There is no legal requirement that one proceeding must conclude before the other can begin or continue, and pursuing both simultaneously is common practice, particularly since the evidence and grounds often overlap significantly, with the cruelty alleged in your criminal complaint frequently also serving as grounds for divorce under matrimonial law. However, it is worth being strategically mindful that the outcome or evidence in one proceeding can sometimes be referenced in the other, so consistency in your statements and evidence across both matters strengthens your overall position rather than creating contradictions that the opposing side could exploit.

Family courts in Kolkata are generally accustomed to handling divorce petitions where a related criminal complaint is pending, and this parallel litigation does not, by itself, disadvantage either proceeding, though coordinating your legal strategy across both matters with the same or closely coordinated legal team tends to produce more coherent and effective outcomes overall.

Because managing two related but procedurally distinct cases requires careful coordination to ensure your evidence and testimony remain consistent and mutually reinforcing, it helps considerably to have both handled with a unified strategy. Aapka Legal Advice can help ensure your criminal complaint and divorce petition work together effectively rather than in isolation.

If you're pursuing both a criminal harassment complaint and divorce in Kolkata, know that you can proceed with both simultaneously. Speak with experienced criminal lawyers in Kolkata about coordinating both matters for the strongest possible outcome.
