The primary person harassing me in my matrimonial home is my mother-in-law who instigates all the abuse. My husband merely follows her directions. Can a criminal complaint for marital harassment be filed against a female family member like a mother-in-law or sister-in-law and what provisions cover such cases in Kolkata?

If a female relative of your husband, such as a mother-in-law or sister-in-law, has been actively involved in harassing you in Kolkata, yes, you can absolutely name her as an accused in your complaint, since Indian law makes no distinction based on gender when it comes to liability for cruelty and harassment within a matrimonial context. Section 85 of the Bharatiya Nyaya Sanhita (formerly Section 498A IPC) refers broadly to "relatives" of the husband without limiting this to male family members, meaning a mother-in-law, sister-in-law, or other female relative who has genuinely participated in cruel or harassing conduct can face criminal liability just as a male relative would.

Similarly, under the Protection of Women from Domestic Violence Act, 2005, the definition of "respondent" was clarified by the Supreme Court to include female relatives of the husband as well, meaning you can seek protection orders and other reliefs against female family members who are perpetrating or actively participating in domestic violence, not just against male members of the household. This closed an earlier ambiguity in the law and ensured that harassment by mothers-in-law or sisters-in-law, which is unfortunately common in many households, has clear legal recourse.

As with complaints against any relative, the key to a successful case against a female family member lies in specificity; your complaint needs to clearly document the particular conduct of that individual, whether verbal abuse, active participation in isolating you, physical mistreatment, or other harassing behaviour, rather than a general allegation that simply names her as part of the household without detailing her specific role.

Because courts scrutinise complaints against extended family members carefully to prevent misuse, having a well-documented, specific account of the female relative's conduct significantly strengthens your case. Aapka Legal Advice can help you draft a complaint that clearly establishes her individual role in the harassment you've faced.

If a female family member has actively harassed you in Kolkata, the law allows you to hold her accountable just as you would any other relative. Speak with experienced criminal lawyers in Kolkata about including her appropriately in your complaint.
