After I filed a complaint for mental harassment against my husband he has now filed a counter complaint against me claiming I was the one who harassed him emotionally and financially. Can a husband file a criminal complaint for mental harassment or cruelty against his wife and what is the legal position on such counter complaints in Kolkata?

If you are a husband in Kolkata facing a complaint from your wife and believe you have also been subjected to genuine harassment or false accusations, you do have legal options, though it's important to understand these operate somewhat differently than a wife's remedies under matrimonial cruelty law. While Section 85 of the Bharatiya Nyaya Sanhita specifically addresses cruelty by a husband or his relatives toward a wife and doesn't have a direct gender-reversed equivalent, a husband facing genuine harassment, whether through false complaints, threats, or actual abusive conduct from his wife, is not without recourse under general criminal and civil law.

If you believe your wife's complaint against you is false or exaggerated, your primary and most effective defence lies within the same proceeding, through your advocate demonstrating the falsity or lack of merit of the allegations during investigation or trial, and where appropriate, pursuing an application for quashing before the Calcutta High Court if the complaint appears to be a clear abuse of process without genuine substance. Separately, if the false complaint has caused you genuine reputational or financial harm, you may be able to pursue civil remedies for malicious prosecution once the criminal case concludes in your favour, though this is a distinct and separate legal track.

For situations involving actual harassment, threats, or abusive conduct by a wife, general provisions relating to criminal intimidation, assault, or other applicable offences under the Bharatiya Nyaya Sanhita remain available to a husband just as they would to any other citizen, since these provisions are not gender-specific in their application. Additionally, if your children are being affected or custody and residence issues arise, family court proceedings can address these concerns directly.

Because navigating a counter-complaint or defence strategy in a matrimonial dispute requires careful handling to avoid appearing retaliatory while still protecting your legitimate rights, professional guidance matters considerably here. If you are a husband facing what you believe is unwarranted harassment or a false complaint in Kolkata, you have legitimate options to protect yourself. Speak with experienced criminal lawyers in Kolkata about the best strategy for your case.
