I pleaded guilty before the Magistrate under pressure from my lawyer without fully understanding the consequences. After the guilty plea was recorded the court has not yet passed the sentence. Can I withdraw or change my guilty plea before sentencing and on what grounds will the court consider such a request in Kolkata?

If you pleaded guilty in a Kolkata criminal case and have since realised this was a mistake, whether due to pressure, misunderstanding, or new circumstances, you may be able to withdraw that plea, though the window for doing so is important to understand clearly. Indian courts generally allow an accused to withdraw a guilty plea before sentencing has actually been pronounced, particularly if it can be shown that the plea was not made voluntarily, was based on a misunderstanding of the charges or consequences, or was entered without proper legal advice at the time.

Once sentence has already been pronounced based on a guilty plea, withdrawing it becomes considerably harder, though not entirely impossible; your remedy at that stage generally shifts toward filing an appeal or revision, arguing that the conviction based on the guilty plea should be set aside because the plea itself was invalid or improperly recorded. Courts examine whether the trial court, at the time of recording your guilty plea, properly explained the charge to you in a language you understood and ensured you comprehended the consequences of pleading guilty, since procedural safeguards exist specifically to prevent uninformed or coerced guilty pleas.

If you're still within the window before sentencing, the process typically involves your advocate filing an application before the trial court explaining the circumstances under which the guilty plea was entered and requesting permission to substitute it with a plea of not guilty, after which the trial would proceed in the normal course with evidence being led and tested. Courts in Kolkata generally exercise discretion favourably where there is a genuine and credible explanation for the change.

Because timing is so critical here, and the grounds you present for withdrawal significantly affect whether the court permits it, this needs prompt and carefully prepared legal action. Aapka Legal Advice can help you move quickly to withdraw an unintended or improperly entered guilty plea before it's too late.
