The criminal trial against me is being held in a court where I genuinely fear I cannot get a fair hearing due to local influence of the complainant and his proximity to the local administration. Can I seek transfer of my criminal trial to a different court or district and what is the procedure in Kolkata?

If you have genuine concerns about receiving a fair trial in the particular court in Kolkata where your case is currently pending, you can apply for transfer of the case to another court, and Indian law provides a clear mechanism for this. Under Section 406 CrPC for transfers at the Supreme Court level, or more commonly Section 407 CrPC for transfers within a state (now the corresponding BNSS provisions), you can approach the Calcutta High Court seeking transfer of your trial to a different court or even a different district within West Bengal, provided you can demonstrate valid grounds for doing so.

Recognised grounds for seeking transfer include a reasonable apprehension that you will not receive a fair and impartial trial in the current court, communal or local tension that might affect witnesses or the proceedings, the personal safety of the accused or witnesses being at risk in the current location, or circumstances suggesting bias on the part of the presiding judge that cannot be resolved through a simple recusal request. Courts require the apprehension to be reasonable and based on objective circumstances, not merely a subjective feeling of unease, since transfer applications, if allowed too easily, could be misused to delay proceedings or forum-shop for a more favourable court.

The application for transfer needs to be supported by specific facts and, where possible, documentary evidence supporting your apprehension, and it is typically filed at a stage where the concern has become apparent, rather than as a last-minute tactic close to judgment. The Calcutta High Court examines such applications carefully, balancing the accused's right to a fair trial against the general principle that cases should ordinarily be tried where the offence occurred or the parties reside.

Because transfer applications require solid factual grounding to succeed, and weak applications can sometimes reflect poorly on your case, it's important to have the specific circumstances assessed carefully before filing. Aapka Legal Advice can help evaluate whether your concerns meet the threshold courts require for granting a transfer.

If you have genuine and specific concerns about fairness in your current trial court in Kolkata, this is worth raising properly rather than staying silent. Consult experienced criminal lawyers in Kolkata about whether a transfer application is appropriate for your case.
