I have been granted anticipatory bail but the court has imposed a condition requiring me to surrender all my foreign travel documents including passport. Can such a condition be challenged as disproportionate and what is the procedure to seek modification of this specific condition in Kolkata?

If you've applied for or been granted anticipatory bail in Kolkata, you may find that the court has imposed a condition requiring you to surrender your passport or other foreign travel documents, and yes, this is a legally valid and fairly common condition, particularly in cases involving allegations of financial fraud, serious offences, or where the court has genuine concerns about flight risk given your ability to travel internationally. Courts derive this power from the broad discretion granted under Section 438 CrPC (now Section 482 BNSS) to impose any conditions considered necessary in the interest of justice, and passport surrender is one of the most commonly used conditions to address flight risk concerns specifically.

While this condition can feel restrictive, particularly if you have genuine personal or professional reasons to travel internationally, it is not necessarily a permanent or absolute restriction; if a specific and genuine need to travel arises during the pendency of your case, your advocate can move an application before the same court seeking temporary release of your passport for a defined period, supported by documentation establishing the purpose of travel, such as a business commitment, family emergency, or medical necessity, along with an undertaking to return within the specified timeframe.

Courts in Kolkata generally examine such applications on their individual merits, and where you have consistently complied with all other bail conditions and can demonstrate a genuine and time-bound need to travel, requests for temporary passport release are often considered favourably, particularly if additional safeguards like enhanced security or reporting requirements can address the court's continuing concern about flight risk during your travel period.

Because navigating passport-related bail conditions, both accepting them initially and seeking exceptions when genuinely needed, requires careful legal handling, it helps to have experienced guidance on both fronts. Aapka Legal Advice can help you understand and, where necessary, seek modification of travel-related bail conditions in your case.

If your anticipatory bail in Kolkata includes surrender of your passport and you have a genuine need to travel, this can often be addressed through the right application. Speak with experienced criminal lawyers in Kolkata about your options.
