I have been tried in a court in a city where I claim the offence did not take place. Can I raise the objection of territorial jurisdiction before the criminal court and at what stage of proceedings must this objection be raised to be effective in Kolkata?

If you believe the court trying your case in Kolkata simply doesn't have territorial jurisdiction over the alleged offence, yes, this is a legitimate and often powerful objection you can raise, and Indian criminal procedure takes territorial jurisdiction seriously. Under Sections 177 to 189 CrPC (now the corresponding BNSS provisions), the general rule is that an offence must be tried by a court within whose local jurisdiction it was committed, though there are specific exceptions for offences that span multiple locations, continuing offences, or situations involving consequences that occur in a different place than the original act.

If your case involves allegations where the actual offence, or a significant part of it, occurred outside Kolkata's jurisdiction, this is worth raising as a preliminary objection, ideally at the earliest possible stage of trial, since jurisdictional objections raised too late can sometimes be treated as waived, particularly if you have already participated substantially in the proceedings without raising the issue. Courts examine jurisdiction based on where the essential ingredients of the offence took place, not merely where the complaint happened to be filed or where the complainant resides.

It's worth noting that jurisdiction under Indian criminal law can be more flexible than people expect, particularly for offences like cheating or criminal breach of trust involving multiple transactions across states, where courts have held that jurisdiction can lie wherever any part of the transaction occurred. This means a jurisdictional challenge requires careful factual analysis of exactly where each element of the alleged offence took place, rather than a simple assumption based on where you or the complainant live.

Because getting this wrong, either by raising a weak objection or by missing a genuinely strong one, can significantly affect your case strategy, it's important to have the facts of your case properly mapped against the applicable jurisdiction provisions. Aapka Legal Advice can help assess whether a jurisdictional challenge is likely to succeed in your specific matter.

If you believe your case in Kolkata is being tried in the wrong court territorially, raise this early rather than after significant proceedings have taken place. Consult experienced criminal lawyers in Kolkata to evaluate your jurisdictional objection thoroughly before filing it.
