The trial court has convicted me and sentenced me to imprisonment. I intend to file an appeal before the Kolkata Sessions Court or Kolkata High Court. Can I apply for suspension of the sentence and stay of imprisonment while my appeal is being heard and what factors will the court consider?

Being convicted is a frightening moment, but if you intend to appeal, Indian law gives you a genuine avenue to seek suspension of your sentence pending that appeal, and courts in Kolkata exercise this power regularly. Under Section 389 CrPC (now the corresponding BNSS provision), the appellate court, or in some cases even the trial court that passed the conviction, has discretion to suspend the sentence and release the convicted person on bail while the appeal is being heard. This is especially significant if you are facing imprisonment, since without a stay, you could end up serving a substantial part of your sentence before the appeal is even decided.

Whether a stay of sentence is granted depends on several factors that Kolkata courts weigh carefully, including the nature and gravity of the offence, whether the conviction rests on debatable evidence, the sentence awarded, your prior conduct, and the likely delay in the appeal being finally heard. Courts are generally more willing to suspend sentences in cases involving shorter jail terms, first-time offenders, or where a genuine and arguable point of law has been raised in the appeal memo. In serious offences carrying long sentences, the threshold for suspension is understandably higher.

The application for suspension of sentence is usually filed along with the appeal itself, and it is important that your appeal memo clearly identifies the legal or factual errors in the trial court's judgment, since a well-drafted appeal significantly improves the chances of getting bail during its pendency. Delay in filing can work against you, so it is advisable to move the stay application immediately after conviction rather than waiting.

This is a time-sensitive process where the quality of your appeal drafting genuinely affects whether you get interim relief. Getting guidance from Aapka Legal Advice at this stage can help ensure your appeal and stay application are filed without losing precious time, since every day in custody matters.

If you've been convicted in Kolkata and are planning to appeal, don't delay in seeking suspension of your sentence. Speak promptly with skilled criminal lawyers in Kolkata who can move your appeal and stay application together, giving you the best chance of remaining out of custody while your case is reconsidered.
