The primary source of harassment in my marriage has been my mother-in-law and sister-in-law who constantly insult, threaten and humiliate me. My husband supports their behaviour. Can I name my in-laws as accused persons in a criminal complaint for mental cruelty and what is the legal basis for including them in Kolkata?

If members of your husband's family, not just your husband, have actively participated in causing you mental harassment in Kolkata, yes, they can be named as accused alongside him in your criminal complaint. Section 85 of the Bharatiya Nyaya Sanhita (formerly Section 498A IPC) specifically extends liability to "relatives" of the husband, meaning in-laws including mothers-in-law, fathers-in-law, sisters-in-law, and other family members can be prosecuted if they have engaged in conduct that meets the legal threshold for cruelty.

That said, courts have grown increasingly cautious about complaints that name every family member indiscriminately without specifying individual roles, since the Supreme Court has repeatedly cautioned against the misuse of this provision to implicate relatives who had no real involvement in the harassment, sometimes referred to as "over-implication." To ensure your complaint against in-laws is taken seriously and survives scrutiny, it needs to clearly specify what each named individual actually did or said, rather than making generalised allegations against the entire family collectively.

Courts in Kolkata examine such complaints for specificity, and a well-drafted complaint detailing particular instances involving each in-law, whether it's a mother-in-law's repeated taunts, a sister-in-law's active participation in isolating you, or a father-in-law's role in financial control, is far more likely to result in effective legal action than a broad, undifferentiated complaint against the whole family. Vague complaints risk being quashed at a preliminary stage if the High Court finds no specific role attributed to a particular relative.

Because getting the drafting right significantly affects whether your complaint against in-laws holds up, it's worth having it prepared by someone experienced in how Kolkata courts scrutinise these matters. Aapka Legal Advice can help ensure each individual's specific role in the harassment is clearly documented in your complaint.

If your in-laws have played an active role in the mental harassment you've faced in Kolkata, you can pursue action against them specifically. Speak with experienced criminal lawyers in Kolkata about drafting a complaint that holds up to legal scrutiny.
