My husband has never physically harmed me but has subjected me to continuous verbal abuse, humiliation in front of family, threats and emotional manipulation for years. Can mental cruelty without any physical violence be prosecuted as a standalone criminal offence under Indian law and under which provision should I file a complaint in Kolkata?

If you are experiencing ongoing mental cruelty from your husband in Kolkata, you don't need to wait for physical violence before the law can protect you, since mental cruelty is independently recognised as a criminal offence under Indian law. Section 85 and 86 of the Bharatiya Nyaya Sanhita (formerly Section 498A IPC) specifically criminalise cruelty by a husband or his relatives towards a wife, and the definition of cruelty under this provision explicitly includes wilful conduct likely to drive a woman to suicide or cause grave injury to her mental health, not just physical harm. This means sustained mental cruelty, on its own, can absolutely form the basis of a standalone criminal complaint.

Courts across India, including those in Kolkata, have consistently interpreted this provision broadly to cover conduct such as persistent humiliation, threats, taunts over dowry, being ignored or isolated within the household, and psychological manipulation that causes genuine mental suffering, even where no physical injury exists. The law recognises that mental cruelty can be just as damaging, and sometimes more insidious, than physical abuse, and prosecutors and courts in West Bengal treat these complaints with appropriate seriousness when the facts support them.

To pursue such a complaint, you would typically approach the local police station to register an FIR, or file a complaint directly before a Magistrate under the applicable BNSS provisions if you prefer that route. Since mental cruelty cases often rely heavily on your testimony and any supporting evidence like messages, witness accounts from family or friends, or medical records reflecting your psychological state, building a well-documented complaint from the outset makes a significant difference to how the case proceeds.

Because mental cruelty cases require careful articulation of the pattern of behaviour rather than a single incident, it helps considerably to have your complaint drafted by someone experienced in matrimonial criminal law. Aapka Legal Advice can help you document your experience clearly and file a complaint that reflects the true extent of what you've endured.

If you are facing mental cruelty in your marriage in Kolkata, know that the law recognises this as a serious offence on its own. Speak with experienced criminal lawyers in Kolkata about filing a complaint and protecting yourself going forward.
