I have preserved screen recordings and screenshots of the abusive messages, fake profiles and defamatory posts that form the basis of my cybercrime complaint. Will Indian criminal courts accept screen recordings and screenshots as valid electronic evidence and what formalities must be followed to make them admissible in Kolkata?

If you have screen recordings or screenshots documenting cybercrime, harassment, or fraud committed against you in Kolkata, this evidence can indeed be accepted by courts, provided it meets certain authentication requirements that ensure its reliability and integrity. Electronic evidence, including screenshots and screen recordings, is governed by Section 63 of the Bharatiya Sakshya Adhiniyam (which replaced Section 65B of the Indian Evidence Act), and courts require this kind of evidence to be accompanied by a proper certificate confirming how the electronic record was produced, ensuring that the evidence hasn't been altered or fabricated.

This means simply presenting a screenshot to the court, without following the required certification process, risks the evidence being challenged or given reduced weight, so it's important to preserve digital evidence properly from the outset, including maintaining the original device where the screenshot or recording was made, avoiding editing or cropping images in ways that could raise authenticity questions, and where possible, having the evidence formally certified by a person familiar with the technical process by which it was captured.

Courts in Kolkata, consistent with the broader approach across Indian courts, generally give significant weight to properly authenticated screenshots and recordings, particularly in cybercrime cases where such evidence often represents the primary or only record of the offending conduct, given the fleeting and easily deletable nature of digital communications. Corroborating your screenshots with other evidence where available, such as witness testimony about what you experienced or additional technical evidence like metadata, further strengthens your case.

Because getting the certification and authentication process right significantly affects whether your crucial evidence actually holds up in court, it's worth having this handled properly from the moment you first discover and document the cybercrime. Aapka Legal Advice can guide you through properly preserving and certifying your digital evidence for maximum evidentiary value.

If you have screenshots or recordings documenting a cybercrime in Kolkata, make sure they're preserved and certified correctly. Consult experienced criminal lawyers in Kolkata about ensuring your evidence holds up in court.
