The person who filed a criminal cheating complaint against me has also filed a civil suit for recovery of the same amount. My lawyer says only one proceeding should be maintained. Can a criminal cheating case and a civil suit for recovery of money arising from the same transaction run simultaneously in Indian courts?

Clients pursuing justice for financial disputes often ask whether a cheating case and a civil recovery suit can run simultaneously, and the reassuring answer is yes, Indian law permits both remedies to proceed together without one barring the other. A cheating case and a civil recovery suit can run simultaneously because criminal proceedings under provisions like Section 318 BNS for cheating address the punitive and deterrent aspect of the wrongdoing, while a civil recovery suit addresses the compensatory aspect of recovering the actual money or property lost, and courts have consistently held that pursuing one does not preclude or automatically stay the other.

This dual-track approach is particularly useful in complex financial disputes, loan defaults involving fraud, or business transactions gone wrong, since a favourable outcome in either proceeding can sometimes support the other, though findings in one are not automatically binding on the other given their different standards of proof — criminal cases require proof beyond reasonable doubt, while civil suits operate on a preponderance of probabilities. A cheating case and a civil recovery suit can run simultaneously with strategic advantages too, since the pressure of a pending criminal complaint sometimes encourages faster settlement or repayment even while the civil suit for recovery continues independently toward judgment.

If you are considering pursuing both remedies, coordinating the timing, evidence, and legal arguments across both proceedings carefully is important to ensure consistency and avoid weakening either case. For strategic guidance on running both a cheating case and a civil recovery suit together effectively, our legal experts at Aapka Legal Advice can help structure your approach for maximum impact.

In summary, a cheating case and a civil recovery suit can run simultaneously, giving victims of financial wrongdoing a powerful combined approach to both punish the wrongdoer and recover their losses.
