I have already filed a divorce petition against my husband citing cruelty. My lawyer is now advising me to also file a criminal complaint for the same acts of harassment. Can criminal proceedings for marital harassment run simultaneously with a pending civil divorce petition and will one affect the outcome of the other?

A criminal marital harassment case can run alongside a divorce petition, and pursuing both simultaneously is common and legally permitted in Indian matrimonial disputes. Since a Section 85/86 BNS criminal complaint and a divorce petition under personal law address different aspects โ€” punishment for cruelty versus dissolution of marriage โ€” a criminal marital harassment case can run alongside a divorce petition without either proceeding being barred by the other, and evidence from one can sometimes support arguments in the parallel case, though the two remain procedurally independent.

Running both together requires careful coordination to ensure consistency in facts presented and to avoid unnecessary duplication of effort or contradictory statements across proceedings, which is where experienced legal strategy becomes especially valuable. Many women find that pursuing both remedies together provides both immediate protection and a clear path toward long-term resolution of the marriage.

For help managing both proceedings in a coordinated, strategic manner, the team at Aapka Legal Advice can ensure your criminal complaint and divorce petition work together effectively rather than at cross-purposes. Our network of Top Criminal Lawyers in India and retired judges panel bring valuable combined experience to exactly this kind of dual-track matrimonial litigation.
