All my bank accounts and assets have been frozen by the investigating agency in connection with a financial crime case. I am now unable to pay my lawyer's fees. Can a court direct that a portion of frozen assets be released specifically for the purpose of meeting legal defence expenses?

A very practical concern for clients facing asset freezes is whether frozen assets can be used to pay legal fees in an economic offence case, since mounting legal costs alongside frozen finances create real hardship. Generally, frozen assets cannot be used to pay legal fees in an economic offence case without specific court or authority permission, since a freezing or attachment order restricts the accused from dealing with, transferring, or utilising the property in any manner, including for expenses, until the order is modified or vacated. However, courts do have discretion to permit limited release of funds for genuine, reasonable purposes, including legal representation, particularly where the accused can demonstrate no other means of funding their defence.

In practice, whether frozen assets can be used to pay legal fees in an economic offence case depends on filing a specific application before the relevant authority, whether the Adjudicating Authority under PMLA, the Special Court, or the investigating magistrate, clearly setting out the necessity for funds, the absence of alternative resources, and a request for either a fixed sum release or permission to access a defined, non-tainted portion of the frozen assets if such distinction can be established. Courts are generally more receptive to such applications when the accused can show that at least part of the frozen assets are demonstrably unconnected to the alleged proceeds of crime.

Given how essential proper legal representation is in economic offence matters, addressing this funding challenge early is important rather than letting it stall your defence. For assistance drafting an application seeking release of funds specifically for legal expenses, the team at Aapka Legal Advice can help present a compelling case tailored to your financial situation.

Our network of Top Criminal Lawyers in India, together with our retired judges panel's understanding of how such applications are typically assessed, can help you navigate this often-overlooked but critical practical hurdle.

In conclusion, while frozen assets generally cannot be used to pay legal fees in an economic offence case without permission, a well-drafted application can often secure limited relief, making it worth pursuing rather than assuming the door is entirely closed.
