My husband has never physically harmed me but has subjected me to continuous verbal abuse, humiliation in front of family, threats and emotional manipulation for years. Can mental cruelty without any physical violence be prosecuted as a standalone criminal offence under Indian law and under which provision should I file a complaint?

Many women ask us whether mental cruelty by husband can be a standalone criminal offence even without any physical violence, and the answer is clearly yes under Indian law. Mental cruelty by husband can be a standalone criminal offence under Section 85 and 86 of the Bharatiya Nyaya Sanhita (formerly Section 498A IPC), which specifically defines cruelty to include wilful conduct likely to drive a woman to suicide or cause grave injury to her mental or physical health, as well as harassment connected to unlawful demands. Courts have consistently held that mental cruelty alone, without a single physical blow, is sufficient to sustain a criminal complaint, since the law recognises psychological harm as equally serious.

This means constant humiliation, threats, degrading comments, control over daily life, isolation from family, or persistent taunts about dowry or appearance can all form the basis of a cruelty complaint. Courts assess the cumulative pattern of behaviour rather than requiring one dramatic incident, so a consistent record of such conduct strengthens your case considerably. Filing this complaint requires documenting incidents carefully, ideally with dates, witnesses, and any supporting communication.

If you are experiencing this and unsure how to formalise your complaint, Aapka Legal Advice can help you translate your experience into a legally sound complaint under Section 85/86 BNS. Our network of Top Criminal Lawyers in India, together with our panel of retired judges who bring bench-level insight into how such complaints are assessed, can guide you confidently through this process, ensuring your voice is heard and your rights protected from the very first step.
