My brother got into a scuffle with people from another family over the past year, and an FIR was lodged naming several of us, most of whom are not mentioned individually in the charge sheet. Given this situation, I want to know: Can the Magistrate Court discharge an accused in a case involving use of a weapon under Section 239 CrPC / the corresponding discharge provision under BNSS?
