A dispute between two families in our neighbourhood led to a complaint under the POCSO Act being filed against my relative just last month, and the case is now nearing the stage of framing of charge. Given this situation, I want to know: Can the Special Court (Sessions-equivalent) discharge an accused in a case where the victim's age is disputed under POCSO under Section 227 CrPC / the corresponding discharge provision under BNSS?
