An appeal against conviction has been pending before the Bombay High Court for a considerable period. Is there any mechanism to seek an expedited hearing?

I will give you the honest answer rather than a reassuring but empty one: there is no fixed statutory timeline for the disposal of most criminal appeals before the Bombay High Court, and realistic timelines vary from months to years depending on the nature and complexity of your appeal, the current pendency, and the category your matter falls into. The Bombay HC carries one of the largest criminal appellate dockets in India, and appeals move at different speeds according to their urgency and classification.

Your immediate and most important concern — if you are a convicted person — is your liberty while waiting. If suspension of sentence and bail pending appeal under Section 430 BNSS has not yet been secured, that application at the Bombay HC in Mumbai is the first and most urgent priority. A pending appeal argued from freedom is a fundamentally different experience from one argued from custody, and the Bombay HC grants bail pending appeal in a wide range of matters where the appeal raises arguable questions. If the Nashik Sessions Court declined the suspension, move the application directly to the Bombay HC.

Beyond bail, you can seek an early hearing or expedited listing where genuine compelling grounds exist — continued custody while the sentence may be largely served before the appeal is heard; a strong prima facie case of miscarriage of justice visible from the record; serious illness or advanced age of the appellant; or statutory disposal timelines applicable to your case category. These applications, properly supported, do materially improve listing at the Bombay HC. Experienced criminal appeal advocates at the Nashik panel of Aapka Legal Advice who appear regularly before the Bombay HC in Mumbai can assess whether your matter qualifies for expedited listing and press the application effectively. Secure bail pending appeal first, pursue early hearing where the grounds exist, and do not simply wait for the ordinary queue.
