Valuable gifts were given to me by my spouse's family during and after the marriage. My spouse is now claiming these gifts back during the divorce proceedings before the Bengaluru Family Court. Do these gifts legally belong to me and can my spouse claim them back?

Yes, you can claim ownership of gifts received from your spouse's family during divorce proceedings in Bengaluru, and Indian law provides fairly clear protection for such claims, particularly through the concept of "streedhan," which legally belongs exclusively to the wife regardless of how the marriage ultimately ends.

Streedhan refers to all property, jewellery, gifts, and valuables given to a woman before, during, or after her marriage, from either her own family or her husband's family, and it remains her absolute property under Hindu law, distinct from any joint matrimonial assets. This means that gifts received from your spouse's family during the marriage do not become the property of your husband or his family simply because the marriage has broken down โ€” they remain legally yours, and you are entitled to claim their return or their monetary value if they have been withheld from you.

If your spouse or in-laws refuse to return such gifts or streedhan after separation, you can seek recovery through your divorce proceedings in Bengaluru by including a specific prayer for return of streedhan, or file a separate application under the Protection of Women from Domestic Violence Act, 2005, which explicitly recognises streedhan as part of a woman's right to residence and property protection. In more serious cases involving deliberate withholding, you can also pursue a criminal complaint under Section 406 of the Indian Penal Code (criminal breach of trust, now under the Bharatiya Nyaya Sanhita, 2023) if the property was entrusted to your husband or his family and then dishonestly retained.

To succeed in such a claim, documentation matters significantly โ€” wedding photographs showing the gifts, receipts or invoices, witness testimony from family members present at the time of gifting, and any list of streedhan items prepared around the time of marriage all strengthen your position considerably. Courts in Bengaluru have granted streedhan recovery in numerous matters where such supporting evidence was presented convincingly, even years after separation.

Because streedhan claims often involve tracing items back to specific occasions and proving ownership convincingly, experienced legal guidance from the outset makes a meaningful difference. The team at Aapka Legal Advice has helped numerous women in Bengaluru recover streedhan through both civil and criminal channels. Its divorce lawyers in Bengaluru, working with a panel of retired judges available for consultation, can help you compile the evidence needed to support your claim effectively.

In short, yes, gifts received from your spouse's family during marriage are legally yours as streedhan, and you can pursue their return through your Bengaluru divorce proceedings or through parallel civil and criminal remedies.
