My spouse and in-laws are refusing to return my jewellery, gifts and personal belongings after the divorce in Bengaluru. I have receipts and photographs of these items. What legal remedy do I have specifically for recovery of stridhan after divorce and which forum in Bengaluru should I approach?

Stridhan is one of the most misunderstood areas of matrimonial law, and if your spouse or in-laws are refusing to return stridhan after divorce in Bengaluru, you should know that the law is unambiguously on your side. Stridhan — comprising gifts, jewellery, and property given to the wife before, during, or after marriage — remains her absolute personal property under Hindu law, regardless of the marriage's outcome, and neither the husband nor his family acquires any ownership right over it merely by holding it in custody.

The legal position when a spouse refuses to return stridhan after divorce in Bengaluru is that the wife retains full ownership throughout, and wrongful retention can amount to criminal breach of trust under Section 406 IPC (now Section 316 BNS), in addition to being pursued as a civil recovery claim. The Supreme Court has repeatedly affirmed that stridhan does not become joint family property or the husband's property simply because it was entrusted to him or his family during the marriage for safekeeping.

To recover your stridhan, you can pursue a criminal complaint for breach of trust if the property was entrusted and wrongfully withheld, and simultaneously file a civil suit for recovery of specific property or its monetary value if the items cannot be physically returned. Additionally, the Protection of Women from Domestic Violence Act, 2005 explicitly allows a wife to seek an order for the return of stridhan as part of her application for relief, making it one of the more accessible remedies available even alongside ongoing divorce proceedings.

Strong documentation makes an enormous difference in these cases — wedding photographs and videos showing jewellery, gift lists exchanged between families, insurance valuations, purchase receipts, and witness testimony from family members who were present all help establish exactly what was given and its value. Without such documentation, courts can still rely on customary practice and family testimony, but a well-documented claim moves faster and more decisively.
