I have just filed my divorce petition before the Chennai Family Court and the first hearing is scheduled after six weeks. I have no income and urgently need financial support. Can I file for interim maintenance before the first hearing of the divorce case itself and on what basis will the court grant or reject it?

Yes, interim maintenance can be claimed in Chennai even before the first substantive hearing of your divorce case, since Section 24 of the Hindu Marriage Act allows either spouse to apply for interim maintenance at any stage of the proceedings, including immediately upon filing, recognising that financial need does not wait for the formal litigation schedule to unfold.

To claim interim maintenance early in your Chennai case, you can file the application simultaneously with, or shortly after, your main divorce petition, presenting evidence of your financial need and your spouse's income and capacity to pay, allowing the court to schedule an expedited hearing on this interim application even while the broader case proceeds. Courts recognise that delaying interim maintenance determination could cause genuine hardship.

The Chennai family court will typically conduct a relatively summary hearing on the interim maintenance application, examining financial affidavits and supporting documents without requiring the extensive evidence presentation reserved for the main trial. This streamlined approach allows for quicker resolution of the immediate financial need.

It is important to file your application with clear and organised financial documentation from the outset, since a well-prepared application is far more likely to receive prompt and favourable consideration. Consulting the team at Aapka Legal Advice can help you prepare a strong interim maintenance application to be filed early in your Chennai divorce proceedings.

Given the importance of securing timely financial support during often lengthy litigation, obtaining a second opinion from a retired judge on how to expedite and strengthen your interim maintenance request can provide valuable strategic guidance. Experienced divorce lawyers and retired judges are available through Aapka Legal Advice's Chennai divorce lawyer directory.

In conclusion, interim maintenance can indeed be claimed in Chennai before the first substantive hearing of your divorce case, and filing this application promptly and with strong supporting documentation ensures you receive necessary financial support without unnecessary delay.
