I was pressured by my family to marry against my will and have never accepted this marriage emotionally. Is marriage under undue family pressure or lack of free consent a valid ground to seek divorce or declare the marriage void before the Delhi Family Court?

Yes, if your marriage was performed under undue family pressure that amounted to coercion rather than genuine consent, this can absolutely support a petition for annulment or divorce in Delhi, since Indian matrimonial law recognises that marriage requires free and voluntary consent, and consent extracted through significant pressure, threats, or emotional coercion from family members fundamentally undermines the validity of that consent. Under Section 12 of the Hindu Marriage Act, 1955, a marriage entered into under coercion or force can be declared voidable, giving you a legal path to have the marriage annulled rather than simply enduring it.

To succeed with this ground, it's important to distinguish between ordinary family expectations or persuasion, which most marriages in India involve to some degree, and genuine coercion — meaning pressure so severe it effectively overrode your free will, such as threats of serious harm, complete social ostracism, or other extreme measures that left you with no genuine choice in the matter. Courts examine the specific nature and severity of the pressure carefully, since this is a meaningful legal threshold rather than a low bar.

Building a strong case requires clear evidence of the coercive circumstances — witness testimony, communications showing threats or pressure, and a credible, detailed account of the events leading up to the marriage. The timing of your application matters as well, since under Section 12, petitions on this ground generally need to be filed within a reasonable time and before you may have implicitly accepted the marriage through prolonged cohabitation after the pressure ceased.

If annulment isn't the right fit for your specific circumstances, or if too much time has passed for that particular remedy, pursuing divorce on grounds of cruelty may offer an alternative path, particularly if the pressure and its aftermath have continued to affect your wellbeing within the marriage itself.

Given how sensitive and evidence-dependent these cases are, it is worth speaking with our legal experts at Aapka Legal Advice to assess which legal route — annulment or divorce — best fits your specific situation in Delhi.

The Best Divorce Lawyers & Retired Judges in Delhi | Aapka Legal Advice platform connects clients with divorce lawyers experienced in coercion and consent-related matrimonial disputes, along with a panel of retired judges who can offer compassionate, grounded guidance through this difficult process.

In summary, a marriage performed under genuine undue family pressure can support annulment or divorce in Delhi, provided the coercion meets the required legal threshold and is properly evidenced. Careful, honest documentation of the circumstances gives your petition its strongest foundation.
