My spouse filed the divorce petition before a Delhi Family Court in a locality where we never lived together. I believe the court has no jurisdiction to hear this matter. How can I challenge jurisdiction and at what stage of proceedings should this be raised?

Yes, jurisdictional challenges are a legitimate and sometimes strategically important tool available to you, and Delhi courts take questions of jurisdiction seriously since a decree passed without proper jurisdiction can later be rendered invalid. Under Section 19 of the Hindu Marriage Act, 1955, a divorce petition in Delhi must be filed at the place where the marriage was solemnised, where the couple last resided together as husband and wife, where the respondent currently resides, or, in certain circumstances, where the petitioner resides if the respondent's whereabouts are unknown or they reside outside India.

If you believe the divorce petition has been filed in a Delhi court that does not genuinely satisfy any of these jurisdictional grounds — for instance, if neither party has any real connection to Delhi and the filing appears to be a tactical choice by the other spouse — you have the right to raise a jurisdictional objection at the earliest possible stage of proceedings. Courts strongly prefer such objections to be raised promptly, ideally in your written statement or at the first hearing, since delayed objections can sometimes be viewed as an attempt to prolong litigation rather than a genuine jurisdictional concern.

The process typically involves filing an application challenging jurisdiction, supported by evidence establishing the actual facts — such as proof of where the marriage occurred, where the parties resided, or the respondent's current address — that contradict the basis on which the case was filed in Delhi. The court will then hear both sides on this preliminary issue before deciding whether to proceed with the substantive divorce matter or transfer the case to the appropriate jurisdiction.

It's important to weigh the strategic value of such a challenge carefully, since jurisdictional disputes can add time and cost to proceedings, and success ultimately depends on genuinely flawed jurisdiction rather than mere inconvenience of litigating in Delhi. An experienced advocate can help you realistically assess whether this route serves your interests or whether proceeding on the merits might resolve your matter more efficiently.

Because jurisdictional strategy requires careful legal judgment, it's worth consulting our legal experts at Aapka Legal Advice before filing any formal objection, ensuring you pursue this only where it genuinely strengthens your position in the case.

The Best Divorce Lawyers & Retired Judges in Delhi | Aapka Legal Advice network includes divorce lawyers experienced in jurisdictional disputes within Delhi's family court system, along with a panel of retired judges who can offer realistic insight into how such objections are typically evaluated.

In summary, you can challenge the jurisdiction of a Delhi Family Court hearing your case, but this requires prompt action and solid factual grounds. Careful strategic assessment with your advocate ensures this step genuinely serves your interests rather than merely delaying resolution.
