The Family Court in Delhi has passed a divorce decree in my favour. My family is advising me to wait before remarrying. Is there a mandatory waiting period after a divorce decree before I can legally remarry?

This is one of the most important questions to get right, and the cautious answer is that you generally should not remarry immediately after the divorce decree is passed in Delhi, even though the marriage is technically dissolved the moment the decree is granted. The reason is the appeal period: under Section 28 of the Hindu Marriage Act and similar provisions in other matrimonial statutes, either party typically has ninety days to file an appeal against the decree, and remarrying before this period expires, or before any filed appeal is finally decided, carries real legal risk.

If an appeal is filed and eventually succeeds in setting aside the divorce decree after you have already remarried, your second marriage can be rendered legally problematic, potentially exposing you to serious consequences including allegations of bigamy under the Bharatiya Nyaya Sanhita.
