My spouse was aware of being HIV positive before our marriage but concealed this from me. Can deliberate concealment of a serious infectious disease be a ground for divorce before the Delhi Family Court and would it also amount to cruelty?

This is a genuinely serious situation, and yes, you can seek divorce in Delhi if your spouse concealed an HIV diagnosis from you, since this concealment can support your petition through multiple recognised legal grounds under the Hindu Marriage Act, 1955. Deliberately withholding such significant health information from a spouse constitutes both a serious breach of the trust fundamental to marriage and, depending on the circumstances and timing of the diagnosis relative to your marriage, may also support a claim under Section 12 for fraud regarding a material fact if the concealment existed at the time of marriage itself.

More commonly, and often more straightforwardly, this kind of concealment is pleaded as mental cruelty under Section 13(1)(ia), since knowingly withholding critical health information that directly affects your physical safety, wellbeing, and future life decisions represents a profound betrayal that Delhi courts have consistently recognised as causing genuine psychological and emotional harm sufficient to constitute cruelty within a marriage. The deliberate nature of the concealment, rather than merely the diagnosis itself, is what courts focus on most closely.

To build a strong case, medical documentation establishing both the diagnosis and, where possible, the approximate timeline of when your spouse became aware of their condition relative to when they disclosed it to you (or failed to) becomes central evidence. If you can demonstrate your spouse knew of the diagnosis well before informing you, or before your marriage occurred, this significantly strengthens both the cruelty claim and any potential fraud-based argument.

It's also important to address your own health and wellbeing proactively โ€” beyond the divorce proceedings, ensuring you have appropriate medical testing and care is a priority, and your advocate can help ensure any related medical costs or consequences are appropriately factored into settlement discussions and maintenance considerations as part of your overall case.
