I have just filed my divorce petition before the Delhi Family Court and the first hearing is scheduled after six weeks. I have no income and urgently need financial support. Can I file for interim maintenance before the first hearing of the divorce case itself and on what basis will the court grant or reject it?

Yes, interim maintenance can be claimed in Delhi even before the first substantive hearing of your divorce case, since Section 24 of the Hindu Marriage Act allows either spouse to apply for interim maintenance at any stage of the proceedings, including immediately upon filing, recognising that financial need does not wait for the formal litigation schedule to unfold and urgent support may be necessary from the very outset of the case.

To claim interim maintenance early in your Delhi case, you can file the application simultaneously with, or shortly after, your main divorce petition, presenting evidence of your financial need and your spouse's income and capacity to pay, allowing the court to schedule an expedited hearing specifically on this interim application even while the broader divorce case proceeds through its normal timeline. Courts recognise that delaying interim maintenance determination until later stages of litigation could cause genuine hardship to a financially dependent spouse.

The Delhi family court will typically conduct a relatively summary hearing on the interim maintenance application, examining the financial affidavits and supporting documents submitted by both parties, without requiring the extensive evidence presentation and cross-examination process reserved for the main trial on divorce grounds and permanent maintenance. This streamlined approach allows for quicker resolution of the immediate financial need while the substantive matrimonial issues continue to be litigated.

It is important to file your interim maintenance application with clear and organised financial documentation from the outset, since a well-prepared application supported by concrete evidence of need and the other party's capacity to pay is far more likely to receive prompt and favourable consideration than a vaguely pleaded request. Consulting the team at Aapka Legal Advice can help you prepare a strong interim maintenance application to be filed early in your Delhi divorce proceedings.

Given the importance of securing timely financial support during the often lengthy divorce litigation process, obtaining a second opinion from a retired judge on how to expedite and strengthen your interim maintenance request can provide valuable strategic guidance. Experienced divorce lawyers and retired judges are available through Aapka Legal Advice's Delhi divorce lawyer directory.

In conclusion, interim maintenance can indeed be claimed in Delhi before the first substantive hearing of your divorce case, and filing this application promptly and with strong supporting documentation ensures you receive necessary financial support without unnecessary delay.
