I have WhatsApp chats, emails and screenshots that show continuous mental cruelty by my spouse. My divorce case is pending before the Saket Family Court. Will these electronic records be accepted as evidence, and what is the proper way to present them?

Yes, WhatsApp messages, emails, and screenshots can be used as valid evidence in a divorce case in Delhi, including matters pending before the Saket Family Court, provided they are presented in accordance with the law. Under the Indian Evidence Act, electronic records are admissible as evidence, but they must comply with the requirements of Section 65B, which governs the admissibility of digital evidence. This means that simply submitting screenshots or printouts is not enough—you must also provide a proper 65B Certificate confirming the authenticity and source of the electronic record.

In matrimonial disputes, especially on grounds like mental cruelty, courts in Delhi have accepted WhatsApp chats, emails, call records, and other digital communications as supporting evidence, as long as they are genuine and relevant to the case. These records can help establish patterns of behavior, abusive language, threats, or harassment over time.

The correct way to present such evidence is to submit:

  • Printouts or copies of the WhatsApp chats/emails

  • A Section 65B Certificate signed by the person who is in control of the device or who has taken the printout

  • Clear details showing date, time, and identity of the parties involved

It is also advisable to avoid tampering or editing screenshots, as the court may question their authenticity. In some cases, courts may also allow the original device to be produced for verification if required.

Since technical compliance is very important in such matters, it is always better to take guidance from experienced divorce lawyers who understand how to properly draft and file electronic evidence. Seeking support from Aapka Legal Advice can help ensure that your WhatsApp chats and other digital records are presented correctly and effectively, strengthening your case before the Saket Family Court.
