I am a Christian in Delhi and my spouse has committed adultery. My lawyer says adultery was historically the primary ground under the Indian Divorce Act. What grounds are currently available to Christian spouses for divorce before the Delhi Family Court after recent amendments and how is adultery proved in such cases?

Christian couples in Delhi seeking divorce are governed by the Indian Divorce Act, 1869, which was significantly amended in 2001 to bring it more closely in line with grounds available under other personal laws, and this Act specifically provides a defined set of grounds available to Christian spouses seeking to dissolve their marriage. Section 10 of the Act allows either spouse to seek divorce on grounds including adultery, cruelty, desertion for a continuous period of two years, conversion to another religion, incurable unsoundness of mind, virulent and incurable leprosy, and venereal disease in a communicable form, giving Christian couples in Delhi a reasonably comprehensive framework similar in scope to other matrimonial laws.

Additionally, the Act allows for mutual consent divorce under Section 10A, following amendments that brought Christian divorce law more in line with the mutual consent provisions available under Hindu and other personal laws, requiring parties to have lived separately for at least two years before jointly filing for divorce, with this timeframe being notably longer than the one-year requirement under Hindu law, a distinction worth understanding clearly before planning your case timeline.

To pursue a contested divorce under any of these grounds, you would file your petition before the appropriate Family Court in Delhi, following a similar procedural path to other matrimonial cases โ€” presenting evidence supporting your specific ground, going through any court-directed counselling or reconciliation efforts, and ultimately proceeding to trial if the matter isn't resolved through settlement.

It's worth understanding that the specific ground you choose significantly affects both your evidentiary burden and strategic approach, so careful assessment of which ground best fits your circumstances, and whether combining multiple grounds strengthens your overall petition, is an important early step in your case.
