My spouse and I have filed for mutual consent divorce and want the matter resolved quickly. Can the mandatory cooling-off period be waived by the Nashik Family Court?

Yes — and this is one of the most practically important developments in Indian matrimonial law for couples who have genuinely and fully resolved their differences. The Supreme Court's decision in Amardeep Singh v. Harveen Kaur (2017) confirmed that the six-month cooling-off period between the first and second motions in a Section 13B Hindu Marriage Act mutual consent divorce is directory rather than mandatory — the Nashik Family Court can waive it where the circumstances genuinely warrant.

The court will waive the period where it is satisfied that: the marriage has genuinely and irretrievably broken down; the parties have been separated for a substantial period well in excess of the mandatory one-year minimum; there are no minor children requiring the additional time for reflection; the settlement terms are comprehensive, specific, and fair; and both parties are firm and fully informed in their decision. Couples who have been separated for considerably more than a year, have resolved every ancillary issue in a detailed settlement document, and present a well-framed waiver application along with the first motion are the strongest candidates for waiver in Nashik's Family Court.

The procedural route is a joint application for waiver filed alongside the first motion petition, making out each of the above grounds with specific supporting facts. Where all conditions are met, the Nashik Family Court can proceed to decree relatively quickly after the waiver is granted. Preparing a comprehensive, waiver-ready settlement agreement before the first motion filing — ideally with guidance from experienced counsel or a retired judge acting as a neutral mediator — means the waiver application and the first motion can be filed and argued together, minimising overall time.
