I have separated from my husband and he is refusing to return my jewellery and gifts received at the time of marriage. What legal remedy is available in Vadodara to recover my streedhan?

Streedhan — a wife's absolute property comprising the jewellery, gifts, money, and valuables given to her before, during, or after the marriage by her own family, her husband's family, or others — is protected by both civil and criminal law in India, and its recovery after separation is one of the most practically important matters that comes before Vadodara's courts. Let me set out your options clearly, because they are multiple and can be pursued simultaneously.

Your first route is within the divorce proceedings themselves. A prayer for the return of streedhan — with a specific, itemised list of the property claimed — can be included in your divorce petition before the Vadodara Family Court, and the Family Court has jurisdiction to order the return of streedhan as part of the decree. Second, if your husband or in-laws are dishonestly refusing to return your streedhan, this constitutes criminal misappropriation under the BNS, and you can file a criminal complaint before the Magistrate in Vadodara. Third, where domestic violence accompanied the separation, the Protection of Women from Domestic Violence Act 2005 expressly includes economic abuse and streedhan retention within its scope, and a Domestic Violence complaint before a Vadodara Magistrate can secure a Protection Order, a Residence Order, and a monetary relief order directed at the return of streedhan or its monetary value.

The foundation of any successful streedhan claim is documentation. A detailed, written list of every item — with approximate values, the occasion on which it was given, and who gave it — prepared as early as possible after separation is what gives your claim credibility and specificity before the Vadodara courts. Wedding photographs showing items of jewellery, purchase receipts, bank transfer records for gifts, and witness statements from family members who attended the wedding functions all strengthen the claim materially.
