A property dispute regarding my father's house in West Delhi is currently ongoing. My lawyer believes I do not have a legal share in the property, but family members disagree. Before giving up my claim, should I obtain a second opinion from a retired judge?

If you have been advised that you do not have a legal share in your father’s property in Delhi, it is wise not to make any final decision without seeking clarity, and consulting experienced property lawyers for a second opinion can be a very important step. Property disputes, especially those involving family assets, depend heavily on factors like whether the property is ancestral or self-acquired, whether there is a valid will, and the applicable succession laws.

In Delhi, if the property is self-acquired by your father, he generally has full rights to decide its distribution, and you may not have an automatic share during his lifetime unless he transfers it or passes away intestate (without a will). However, if the property is ancestral or part of a Hindu Undivided Family (HUF), you may have a legal right by birth, depending on the facts of the case. These distinctions are crucial and often lead to differing legal opinions.

Seeking a second opinion is strongly recommended, especially when there is disagreement within the family or when the stakes are high. While consulting a retired judge can provide valuable insight, it is equally effective to approach a senior property lawyer who regularly handles such disputes and is familiar with current legal practices and court interpretations.

Before giving up your claim, you should ensure that all documents—such as title deeds, family settlement records, and any will—are carefully reviewed. A fresh legal assessment may reveal rights or remedies that were previously overlooked.

For a well-informed decision, it is advisable to consult experienced property lawyers and seek guidance from Aapka Legal Advice, who can evaluate your case in detail, clarify your legal position, and help you take the right course of action in your ongoing property dispute.
