I recently discovered that my brothers sold a family property in North Delhi without informing me. I believe I have a legal share in the property. Can I challenge the sale and recover my rights?

If your siblings have sold a family property in Delhi without your consent, it is important to first assess your legal rights, and consulting experienced property lawyers at the earliest can help you take the correct action. Your ability to challenge the sale largely depends on whether the property is ancestral/HUF property or self-acquired property of your parents.

If the property is ancestral or part of a Hindu Undivided Family (HUF), you may have a legal share by birth, and your siblings generally cannot sell the entire property without your consent. In such cases, the sale can be challenged in court to the extent of your share. You can file a civil suit for partition and declaration, seeking recognition of your ownership rights and requesting the court to set aside or declare the sale invalid as far as your share is concerned.

You may also file an application for an injunction to prevent further transfer or construction on the property while the case is pending. If the buyer was aware of your rights or the property was clearly ancestral, courts may take a stricter view of such transactions. However, if the buyer is a bona fide purchaser without notice, the situation can become more complex and may affect the relief granted.

On the other hand, if the property was self-acquired by your father or another family member, and there is a valid will or transfer, your claim may be limited depending on the circumstances. Therefore, it is crucial to examine all title documents, sale deeds, and family records before proceeding.

Since such disputes involve detailed factual and legal analysis, it is advisable to act quickly to avoid further complications. Seeking proper legal advice from experienced property lawyers and consulting Aapka Legal Advice can help you evaluate your share, challenge the sale effectively, and take appropriate steps to protect and recover your rights in the property.
