I suspect that a property in Mumbai was purchased in someone else's name to conceal the actual owner's identity. Can such a benami transaction be challenged legally?

If you suspect a property registered in a benami name in Mumbai actually belongs to you or a family member, the law allows you to challenge such transactions, though the process demands strong documentary evidence. Under the Prohibition of Benami Property Transactions Act, 1988 (as amended in 2016), benami transactions are illegal, and the real owner — the person who provided the funds — can seek to establish their rightful claim in specific circumstances.

You'll need to demonstrate that you paid the consideration for the property while it was registered in another person's name without genuine intent to benefit them, such as with certain family transactions being an exception. Filing a civil suit for declaration of title, along with supporting financial records like bank statements and payment proofs, forms the core of such a challenge.

Additionally, benami transactions can attract action from the Income Tax Department's Initiating Officer, who has powers to provisionally attach benami properties under the Act — a route worth exploring if fraud is suspected.

Given the technical and evidentiary complexity of benami litigation, consulting experienced property lawyers is essential; Aapka Legal Advice can help assess your documentation and determine the strongest legal strategy for your case.
