I suspect that a property in Patna was purchased in someone else's name to conceal the actual owner's identity. Can such a benami transaction be challenged legally?

Encroachment on Patna property — whether by a neighbour who has gradually extended a boundary wall in Kankarbagh, a commercial shop that has expanded onto a residential plot near Ashok Rajpath, or government utilities installed on private land — is addressable through a clear set of legal remedies, and acting before the encroachment consolidates is always better than reversing it after the fact.

For private encroachments, your primary civil remedy is a suit for mandatory injunction before the civil court in Patna, seeking an order directing the encroacher to remove the encroachment and restore your boundary, combined with a claim for mesne profits for the wrongful use of your land. An interim injunction obtained at the outset prevents further construction or expansion while the main suit proceeds — this is critical, because a half-built boundary wall or a partially constructed shed is far cheaper to reverse than a completed structure. File the interim injunction application on the same day as the main suit wherever possible. Where the encroachment violates the sanctioned building plan or the PRDA building regulations, a complaint to the Patna Regional Development Authority or the Patna Municipal Corporation building department can trigger administrative demolition action on the encroaching structure, which is faster than a civil court order.

For encroachments on revenue land — ryot plots, dakhil-kharij recorded land — the Revenue Court system under the Bihar Land Reforms Act and the Tenancy Act provides parallel jurisdiction, and a complaint to the Circle Officer or the Sub-Divisional Officer can result in possession being restored administratively. The Bihar Bhumi portal is your starting point for the land record evidence: a certified copy of the khata-khesra and the plot map from the Tehsil office, combined with the boundary description in your registered deed, establishes your lawful boundary. In cases where the boundary itself is contested, the court appoints a local commissioner to survey and demarcate, and that report becomes the basis for the mandatory injunction. The property lawyers and experienced retired judges at the Patna panel of Aapka Legal Advice can coordinate the civil suit, the PRDA complaint, and if necessary the revenue proceedings for the strongest combined pressure.
