A neighbouring party has encroached upon a portion of my property in Vadodara. What remedies are available to remove the encroachment and protect my ownership rights?

Encroachment on Vadodara property — whether by a neighbour who has gradually extended a compound wall in Alkapuri, a commercial establishment that has expanded onto a residential plot near Sayajiganj, or a road-widening scheme that has encroached on private land — is addressable through a clear set of legal remedies, and acting before the encroachment consolidates is significantly cheaper than reversing it after structures are completed.

For private encroachments by neighbours or adjoining property owners, your primary civil remedy is a suit for mandatory injunction before the civil court in Vadodara, seeking a court order directing the removal of the encroachment and restoration of your boundary, combined with a claim for mesne profits for the wrongful use of your land. An interim injunction prevents further construction while the main suit proceeds — file for this on the day you file the main suit. Where the encroachment violates the VDMC building bye-laws or the building plan sanctioned by the Vadodara Municipal Corporation, a complaint to the VDMC building department can trigger administrative demolition action on the encroaching structure, which is faster than waiting for a civil court order. For encroachments on VUDA scheme lands or GIDC plots, the respective authority has its own complaint mechanisms and demolition powers.

The foundation of any encroachment action is your boundary documentation. The property description in your registered sale deed, the revenue survey plot map (7/12 extract and 8A in Gujarat's Satbara system), and the VDMC property card (Aavak Jamabandhni Card) together establish your recorded boundary. Where the boundary is genuinely disputed, the civil court appoints a commissioner to survey and demarcate — that report is what the court acts on. The property lawyers and retired judges at the Vadodara panel of Aapka Legal Advice can coordinate the civil suit, the VDMC complaint, and where applicable the criminal complaint for mischief in a single coordinated action.
