I have been served a summons in a criminal case for an alleged offence that took place over five years ago. The case appears to be filed well beyond the limitation period. Can I raise limitation as a preliminary objection and seek dismissal of the criminal complaint at the threshold in Bangalore?

If you're facing a criminal complaint in Bangalore that you believe was filed well after the legally permitted time period, limitation can indeed be a valid ground to challenge the proceedings, since Indian criminal law, unlike a common assumption that criminal cases have no time limits, does impose limitation periods for certain categories of offences. Under Section 468 CrPC (now the corresponding BNSS provision), offences punishable with fine only, or with imprisonment up to one year, must generally be filed within one year, offences punishable with imprisonment up to three years within three years, while more serious offences carrying higher punishment have no limitation period at all, meaning this defence is only available for a specific category of relatively less serious offences.

If your case falls within a category subject to limitation and the complaint was genuinely filed beyond the prescribed period, your advocate can raise this as a preliminary objection, and courts are required to examine and address this issue, since proceeding with a time-barred complaint would be legally improper. However, Section 473 CrPC (now the corresponding BNSS provision) does give courts discretion to extend the limitation period and take cognizance even beyond the prescribed time if it is satisfied that the delay has been properly explained, or that it is necessary in the interests of justice to do so, meaning limitation isn't always an absolute bar even when technically exceeded.

This means successfully relying on limitation as a defence in Bangalore requires not just showing that the complaint was filed late, but also that the delay lacks a satisfactory explanation, and courts examine this on a case-by-case basis rather than mechanically dismissing every delayed complaint.

Because whether limitation genuinely bars your case depends on the specific offence, the length of delay, and any explanation offered for it, this requires careful case-specific analysis. Aapka Legal Advice can help assess whether limitation provides a genuine defence in your specific matter.

If you believe the complaint against you in Bangalore was filed beyond the legal time limit, this is worth raising as a defence. Consult experienced criminal lawyers in Bangalore about whether limitation applies to your case.
