The Bangalore Sessions Court has passed an order against me in my criminal matter. My lawyer is unsure whether to file a criminal revision petition or a criminal appeal. Can both a revision petition and an appeal be filed simultaneously against the same criminal court order?

If you're considering challenging an order in your Bangalore criminal case and are unsure whether to file a revision or an appeal, it's important to understand that Indian law generally does not permit you to pursue both remedies simultaneously against the same order, since revision and appeal serve overlapping purposes and courts require you to elect one path rather than pursuing parallel challenges. Under the Bharatiya Nagarik Suraksha Sanhita, where a right of appeal specifically exists against a particular order, the general principle is that revision, which is a more limited, discretionary remedy, should not ordinarily be invoked as an alternative or additional route when appeal is available, since appeal is considered the primary and more comprehensive remedy in such situations.

That said, there are situations where the two remedies address genuinely different orders or aspects of your case, and in such circumstances, pursuing an appeal against a final judgment while separately pursuing revision against a distinct interlocutory order passed during the same proceedings is not considered duplicative, since these would be different orders being challenged through the appropriate remedy for each. Your advocate needs to carefully assess exactly which order you're challenging and confirm which remedy, appeal or revision, is legally the correct and available route for that specific order before proceeding.

If you mistakenly pursue revision when appeal was the appropriate and available remedy, courts in Bangalore may decline to entertain the revision petition on the ground that you should have pursued the appeal instead, potentially causing you to lose valuable time, making it important to get this choice right from the outset rather than needing to correct course midway.

Because choosing the correct remedy, and avoiding wasted time on the wrong procedural path, requires careful assessment of exactly what order you're challenging and what remedies are legally available against it, this needs experienced guidance from the outset. Aapka Legal Advice can help you identify the correct remedy for your specific situation.

If you're deciding between revision and appeal for your Bangalore criminal case, get this choice right the first time. Speak with experienced criminal lawyers in Bangalore about the correct remedy for your order.
