The Delhi Sessions Court has passed an order against me in my criminal matter. My lawyer is unsure whether to file a criminal revision petition or a criminal appeal. Can both a revision petition and an appeal be filed simultaneously against the same criminal court order?

A genuinely important procedural question is whether a criminal revision and an appeal can be filed simultaneously in Delhi, and understanding the specific relationship between these two distinct remedies is important before pursuing either. A criminal revision and an appeal generally cannot be filed simultaneously in Delhi against the same order in most circumstances, since Indian criminal procedure treats these as largely alternative rather than cumulative remedies, meaning a party is generally expected to choose one appropriate route rather than pursuing both against the identical order at the same time.

Where a specific order is genuinely appealable โ€” meaning a substantive right of appeal exists under the applicable procedural framework โ€” courts generally require the appeal route to be pursued rather than revision, since revision is meant to be a more limited, supervisory jurisdiction exercised in circumstances where no direct appeal is available, or in specific situations where the revisional court's narrower supervisory powers are the appropriate mechanism rather than a full appellate review. Where an order is genuinely interlocutory in nature, and no direct appeal lies against it, revision may be the only available remedy, meaning the choice between these two routes is often dictated by the specific nature of the order being challenged rather than being a matter of free choice between simultaneous parallel proceedings.

It is worth understanding that pursuing the wrong remedy, or attempting to pursue both simultaneously where this is not properly permitted, can result in one or both proceedings being dismissed as not maintainable, making it essential to correctly identify which specific remedy applies to your situation before filing, rather than hedging by attempting to pursue multiple routes against the same order at once.

Given how much correctly navigating this choice depends on the specific nature of the order being challenged and the applicable procedural framework, careful legal guidance before filing is essential. Our legal experts at Aapka Legal Advice include retired judges who can advise on the correct remedy for your specific order. Our Criminal Lawyers in Delhi | Aapka Legal Advice regularly advise on and pursue the correct appellate or revisional remedy in Delhi criminal matters.

In conclusion, a criminal revision and an appeal generally cannot be filed simultaneously against the same order in Delhi, making correct identification of the applicable remedy, based on the specific nature of the order challenged, essential before filing either.
