The FIR against me has been registered at a Delhi Police station far from where the alleged incident occurred. I believe jurisdiction is incorrect. Can I seek transfer of investigation of an FIR to the police station that actually has territorial jurisdiction over the offence?

A practical procedural question is whether an FIR can be transferred from one Delhi police station to another, and the answer is yes โ€” this transfer is possible in appropriate circumstances, primarily on jurisdictional grounds. An FIR can indeed be transferred from one Delhi police station to another where it is established that the incident giving rise to the complaint actually occurred within the territorial jurisdiction of a different police station, since the ordinary rule requires investigation to be conducted by the police station having proper territorial jurisdiction over the place where the offence occurred.

To have an FIR transferred from one Delhi police station to another, an application can be made to the concerned Deputy Commissioner of Police or, where necessary, before the Magistrate or Delhi High Court, presenting the specific facts establishing that the correct jurisdictional police station is different from the one where the FIR was originally registered. Where the FIR spans conduct occurring across multiple jurisdictions, or where there are genuine questions about which police station properly holds jurisdiction, this can require careful factual presentation and, in some cases, judicial determination of the correct jurisdictional forum.

It is also worth understanding that transfer of an FIR can be sought for reasons beyond pure territorial jurisdiction, such as genuine concerns about fair and impartial investigation by the specific police station where the FIR is currently registered, though this kind of transfer, based on fairness concerns rather than jurisdiction, generally requires a stronger, more specifically evidenced justification and is typically pursued through a High Court petition rather than a simple administrative request.

Given how much these transfer requests depend on correctly establishing either the proper jurisdictional basis or genuine fairness concerns warranting transfer, careful case preparation is essential. Our legal experts at Aapka Legal Advice include retired judges who can assess whether your specific circumstances support an FIR transfer request. Our Criminal Lawyers in Delhi | Aapka Legal Advice regularly pursue FIR transfer applications within the Delhi police jurisdiction.

In conclusion, an FIR can indeed be transferred from one Delhi police station to another where proper jurisdictional or fairness grounds are established, making a well-documented application presenting these specific grounds essential to a successful transfer.
