I am the complainant in a serious case and I believe the state police are protecting the accused due to political pressure. Can I file a petition before the Hyderabad High Court seeking transfer of investigation from the state police to the CBI and what are the grounds on which such a transfer is ordered?

Yes, the Hyderabad High Court can direct the CBI to investigate a case that is currently being handled by state police in Hyderabad, and this power, derived from the High Court's constitutional writ jurisdiction under Article 226, has been exercised in numerous cases across India where the court is satisfied that state police investigation has been compromised, is unlikely to be fair, or where the case involves circumstances of such gravity or complexity that transfer to a specialised central agency is warranted in the interest of justice. This remedy is exceptional rather than routine, and courts require clear and compelling justification before ordering such a transfer.

The Supreme Court has laid down that this power should be exercised sparingly and only in extraordinary circumstances โ€” where there are credible allegations of state police complicity or bias, where the accused enjoys significant political or administrative influence that could compromise a fair investigation by local police, where the case has significant inter-state or national ramifications, or where continuing state police investigation would genuinely undermine public confidence in the fairness of the process. A general dissatisfaction with the pace or quality of investigation, without more, is typically insufficient to justify this extraordinary step.

The process to seek such a direction involves filing a writ petition before the Telangana High Court, supported by specific, credible evidence demonstrating why state police investigation cannot be trusted to proceed fairly โ€” this might include documented instances of interference, unexplained delays, destruction or suppression of evidence, or credible material suggesting collusion between the accused and elements within the investigating agency. The High Court examines this material carefully before exercising what is recognised as an extraordinary and significant intervention into the ordinary law enforcement structure.

If you believe your case in Hyderabad genuinely warrants CBI intervention, building a well-documented and compelling petition is essential, since courts scrutinise such requests closely to avoid unnecessary duplication of investigative resources or undermining state police authority without adequate cause. Our legal experts at Aapka Legal Advice can help you assess whether your case presents the kind of extraordinary circumstances this remedy requires.

Because seeking CBI transfer requires a compelling, well-evidenced petition and deep familiarity with how courts have approached similar requests, experienced counsel is essential. The Top Criminal Lawyers in Hyderabad | Aapka Legal Advice team, working with retired judges on our panel who understand the threshold courts apply to such petitions, can help you pursue this remedy where genuinely justified. If you believe your Hyderabad case requires CBI investigation instead of continued state police handling, a well-prepared writ petition is the appropriate path forward.
