My criminal trial has been pending for over eight years with no end in sight. I have been on bail throughout but the prolonged uncertainty has devastated my personal and professional life. Can I invoke the right to speedy trial as a fundamental right under the Constitution and seek the Hyderabad High Court's intervention to expedite or conclude my case?

Yes, an accused in Hyderabad can absolutely seek speedy trial as a fundamental right, and this protection is firmly rooted in Article 21 of the Constitution, which guarantees the right to life and personal liberty, and which the Supreme Court has consistently interpreted to include the right to a trial that is conducted within a reasonable time, recognising that prolonged, unexplained delay in criminal proceedings itself constitutes a form of injustice and hardship, regardless of the eventual outcome of the case. This right applies to every accused person, whether in custody or on bail, though the urgency and available remedies can differ depending on whether the accused remains incarcerated during the delay.

If your trial in Hyderabad has been experiencing significant, unexplained delay, the appropriate remedy is to first raise this concern before the trial court itself, seeking expedited proceedings and highlighting the specific pattern of delay, and if this does not yield adequate results, pursuing a writ petition before the Telangana High Court under Article 226, specifically invoking the right to speedy trial and seeking directions for the case to be concluded within a defined and reasonable timeframe. Courts examining such petitions consider the length of the delay, the reasons for it, whether the accused has contributed to or acquiesced in the delay, and the actual prejudice suffered as a result.

It is worth understanding that the right to speedy trial does not translate into a fixed, universal timeframe applicable to every case, since courts recognise that case complexity, the number of witnesses, and genuine investigative or evidentiary challenges can legitimately extend proceedings โ€” but delay attributable to systemic inefficiency, repeated unjustified adjournments, or prosecutorial inaction, particularly where the accused remains in custody throughout, is treated with far greater seriousness and is more likely to result in judicial intervention, including in appropriate extreme cases, quashing of proceedings altogether where the delay has become so extensive that a fair trial is no longer realistically possible.
