I have been tried in a court in a city where I claim the offence did not take place. Can I raise the objection of territorial jurisdiction before the criminal court and at what stage of proceedings must this objection be raised to be effective in Hyderabad?

Yes, you can challenge the territorial jurisdiction of the court trying your case in Hyderabad, and this is a fundamental procedural safeguard, since a criminal court can only try an offence if it has proper territorial jurisdiction over the place where the offence, or a relevant part of it, actually occurred. Under the Bharatiya Nagarik Suraksha Sanhita, jurisdiction is generally determined by the place where the offence was committed, though the law also recognises jurisdiction in certain other places — for instance, where the consequences of the offence occurred, or where any part of a continuing offence took place.

If you believe the Hyderabad court trying your case genuinely lacks territorial jurisdiction — for example, because the alleged offence occurred entirely in another state or district, with no meaningful connection to Hyderabad — this objection should ideally be raised at the earliest possible stage, since courts strongly prefer that jurisdictional objections not be saved as a strategic afterthought late in trial. Raising it early, through a written application before the trial court itself, gives the prosecution a fair opportunity to establish jurisdiction if it genuinely exists, or to have the case transferred to the correct forum if it does not.

Importantly, the law also provides that even if a jurisdictional error is later discovered, a trial is not automatically void unless the error has actually resulted in a genuine failure of justice — meaning if the trial has proceeded fairly and no real prejudice is shown, a purely technical jurisdictional error discovered late may not by itself overturn an otherwise sound conviction. This makes the timing and manner of raising a jurisdiction challenge strategically important, since a well-timed and well-substantiated objection is far more effective than a similar objection raised as a last resort late in proceedings.

For offences with elements spanning multiple locations — such as cheating cases involving online transactions, cheque dishonour matters, or offences committed partly in Hyderabad and partly elsewhere — determining the correct jurisdiction requires careful legal analysis of exactly where each element of the offence occurred, since courts have developed nuanced principles for such multi-location offences. Getting this analysis right early can be decisive, and our legal experts at Aapka Legal Advice can help you assess whether a genuine jurisdictional challenge exists in your specific case.

Because jurisdictional challenges require precise factual and legal analysis, and timing significantly affects their success, experienced criminal lawyers are essential to pursuing this effectively. The Top Criminal Lawyers in Hyderabad | Aapka Legal Advice team, guided by retired judges on our panel who bring practical insight into how jurisdictional objections are actually assessed in court, can help you evaluate and raise this challenge at the right stage.
