I was found in possession of a small quantity of drugs which I claim was for my own personal consumption and not for sale or distribution. What is the legal distinction between possession for personal use and possession for supply under the NDPS Act and can personal consumption be established as a defence in Mumbai?

Yes, personal consumption can be used as a defence in an NDPS case in Mumbai, and this defence is specifically recognised and structured under the Narcotic Drugs and Psychotropic Substances Act, though its availability and effect depend heavily on the quantity of the substance involved, since the Act distinguishes clearly between small quantity, intermediate quantity, and commercial quantity, with correspondingly different legal consequences and defence strategies applicable to each category. Where the quantity recovered falls within the "small quantity" threshold specified for the particular substance, the law provides for a considerably reduced punishment specifically applicable to consumption-related offences, recognising a meaningful distinction between trafficking-related conduct and personal use.

Under Section 27 of the Act, possession of a small quantity of a narcotic drug or psychotropic substance for personal consumption attracts a significantly lesser punishment than possession for any other purpose, and courts examine various factors in assessing whether the personal consumption claim is credible, including the quantity actually recovered relative to the small quantity threshold, the accused's own conduct and statements at the time of recovery, and any evidence of actual drug dependency or usage pattern that supports the claim of personal consumption rather than an intent to sell or distribute.

It is important to understand that this defence becomes considerably more difficult to sustain, and in cases involving commercial or even intermediate quantities, largely unavailable as a meaningful mitigating factor, since the law presumes a more serious purpose โ€” namely trafficking โ€” once the quantity crosses these specified thresholds, placing a heavier burden on the accused to rebut this presumption with credible and specific evidence, which is often difficult to establish convincingly for larger recovered quantities.
