I have preserved screen recordings and screenshots of the abusive messages, fake profiles and defamatory posts that form the basis of my cybercrime complaint. Will Indian criminal courts accept screen recordings and screenshots as valid electronic evidence and what formalities must be followed to make them admissible in Mumbai?

Yes, screen recordings and screenshots can absolutely be accepted as evidence in cybercrime cases in Mumbai, and this form of digital evidence has become central to prosecuting a wide range of online offences, from harassment and defamation to financial fraud, provided it is properly preserved, authenticated, and presented in accordance with the legal requirements governing electronic evidence. Under the Bharatiya Sakshya Adhiniyam, electronic records, including screenshots and screen recordings, are admissible as evidence, but their admissibility depends significantly on satisfying specific authentication requirements designed to ensure the evidence has not been tampered with or fabricated.

The most important requirement for using such evidence effectively is producing a certificate under the relevant provision governing electronic evidence, which confirms the manner in which the electronic record was produced, the device used, and certifies that the record accurately reflects the original information, without which courts may be reluctant to rely heavily on the screenshot or recording alone, however compelling it may appear on its face. This certificate is typically prepared by the person who has custody of or operates the relevant computer system, and obtaining it properly at the time evidence is collected, rather than as an afterthought, significantly strengthens the eventual case.

Beyond the formal certification requirement, practical steps that strengthen the credibility of screenshot and screen recording evidence include preserving the original device on which the content was captured wherever possible, ensuring screenshots clearly show relevant metadata such as timestamps and sender information, capturing the content in a manner that shows the broader context rather than isolated fragments that could be taken out of context, and backing up this evidence in multiple secure locations immediately upon discovery, since digital content can be deleted, edited, or become otherwise inaccessible with the passage of time.
